Das Problem ist, dass Herr Ernsdörffer für einzelne Fahrzeuge mehrere Kfz-Briefe hatte. Darum ging es ja letztendlich auch in seinem Prozess. Hierbei stellt sich dann die Frage, wieviele Briefe für den Cup vorlagen.

Thank you all for your help. I will try to answer all of the questions. If someone could translate the German posts, it would help me. I can read some but not all of it.
The dealer Ernsdoerfer is in jail for tax evasion, and fraud. He is also Bankrupt.
I do have the Fahrzuegbrief, a set of keys and the Kennseichen (liscense plates). I gave Ernsdoerfer a key and the Fahrzeugschein, so the car could be taken on a test drive.
From what I have been told the buyer of the car is a "good faith purchaser" so I can not get the car back. I was told this is German law.
I was told that the amt that took the car and sold it is supposed to check the ownership before selling the car. They did not do this.
My fear is that I will sue Stuttgart for the value of the car, I have a Gutachten from TUEV, however, I will loose because I have no case or a bad lawyer. Then I will have to pay my lawyer 6000 Euro. I want to be confident that I will win.

You leave the car with key and Fahrzeugschein, that the dealer can make a testride. You have the Fahrzeugbrief and the plates. Strange, how can i make a testdrive w/o the plates? You leave a car there and you don't check from time to time? As far as i know, the shop was closed already in November last year. When was the car taken away ?? Strange story of a real "blueeyed" customer.

@ RA Dr. Müller: Also es soll so sein, dass eine Stadt oder Behörde ohne weiteres Eigentum von unbeteiligten Dritten einziehen und weiterverkaufen darf. Und der Käufer soll dann die Ware behalten können? So auf die Tour "Schadeee - Pech gehabt!"?

The dealer has red plates to use for test drives so he didn't need the originals from the car. I wasn't able to check on the car because I had moved back to the states.

the thing is very easy. u need a good lawyer in stuttgart. check them out.
